{"id":7819,"date":"2025-04-19T01:38:38","date_gmt":"2025-04-19T01:38:38","guid":{"rendered":"https:\/\/financeintellect.com\/home-page\/home\/?p=7819"},"modified":"2025-04-19T04:11:07","modified_gmt":"2025-04-19T04:11:07","slug":"hngl-%e2%82%b92200-cr-scam-union-urges-fm-to-act-against-cci","status":"publish","type":"post","link":"https:\/\/financeintellect.com\/home-page\/home\/hngl-%e2%82%b92200-cr-scam-union-urges-fm-to-act-against-cci\/","title":{"rendered":"HNGL \u20b92,200 Cr Scam:  Union urges FM to Act Against CCI"},"content":{"rendered":"\n<p>In an unprecedented move, the workers\u2019 union of Hindustan National Glass &amp; Industries Ltd (HNGIL) has written to Finance Minister Nirmala Sitharaman, raising serious concerns about the conduct of the Competition Commission of India (CCI) in the ongoing \u20b92,200 crore Corporate Insolvency Resolution Process (CIRP) of the company. The letter, dated April 6, 2025, seeks immediate intervention from the Ministry of Corporate Affairs (MCA), alleging that CCI\u2019s actions threaten to derail the resolution process and serve the interests of a private party\u2014AGI Greenpac.<\/p>\n\n\n\n<p><a href=\"https:\/\/agigreenpac.com\/\">AGI Greenpac<\/a> is the second-largest player in the glass packaging industry, proposed a resolution plan to acquire 100% of Hindustan National Glass &amp; Industries Ltd. (HNGIL)&#8217;s shares.<\/p>\n\n\n\n<p>The union has objected to CCI\u2019s decision to file a review petition before the Supreme Court on February 25, 2025, challenging the apex court\u2019s final judgment delivered on January 29, 2025. The judgment had quashed AGI Greenpac\u2019s resolution plan and cleared the path for concluding the CIRP, which was initiated back in October 2021.<\/p>\n\n\n\n<p>The Supreme Court <a href=\"https:\/\/legal.economictimes.indiatimes.com\/news\/litigation\/sc-strikes-down-agi-greenpacs-resolution-plan-for-hindustan-national-glass-industries-ltd\/117721242\">invalidated AGI Greenpac&#8217;s resolution<\/a> plan for Hindustan National Glass &amp; Industries Ltd. (HNGIL) due to non-compliance with the Insolvency and Bankruptcy Code (IBC), specifically lacking prior approval from the Competition Commission of India (CCI).\u00a0The court ordered the Committee of Creditors (CoC) to reconsider resolution plans that had the requisite CCI approval as of\u00a0October 28, 2022, the date the CoC voted on the plans.\u00a0Legal experts said this is a landmark judgement which  means &#8220;the CoC will now reconsider the INSCO resolution plan&#8221;<\/p>\n\n\n\n<p>Calling CCI\u2019s move \u201ccontrary to the final judgment of the Hon\u2019ble Supreme Court,\u201d the letter from Union claims that the regulator\u2019s stance appears to support AGI Greenpac\u2014whose plan was categorically rejected by the Court. AGI had filed its own review petition on February 11, but kept it defective until after CCI\u2019s petition was listed. The union alleges this sequence points to strategic coordination between the regulator and the failed bidder.<\/p>\n\n\n\n<p>The union warns that the review petition could delay the already prolonged insolvency process, jeopardizing the future of more than 10,000 workers. \u201cIf the process is derailed or pushed toward liquidation, AGI Greenpac could effectively become a de facto monopoly,\u201d the letter says, raising red flags about anti-competitive outcomes.<\/p>\n\n\n\n<p>Over half of HNGIL\u2019s financial exposure lies with public sector banks, with SBI alone holding nearly 38%.
