Gunjan Aggarwal , wife of a city-based businessman, has\u00a0slapped a legal notice on a Mumbai based tabloid Mumbai Mirror<\/a> for publishing defamatory\u00a0article against her on the pending proceedings of a case in the Bombay\u00a0High Court faced by her and family.<\/h4>\n

In a legal notice sent through a law firm MZM Legal<\/a>, Gunjan has asked\u00a0the tabloid “Mumbai Mirror<\/a>” to tender an apology for publishing\u00a0defamatory matter against her, failing which she has threatened to\u00a0file civil and criminal defamation cases in appropriate courts against\u00a0the newspaper.<\/p>\n

The tabloid had published the impugned article on April 23 alleging\u00a0that Gunjan is facing contempt petition filed by Vardhman developers\u00a0in the high court for allegedly settling a tenancy dispute of her\u00a0Marine Drive flat in South Mumbai with a Maharashtra politician\u00a0although a court had attached family properties of Gunjan\u2019s family.<\/p>\n

Vardhman Developers<\/a> and Gunjan\u2019s husband, Pujit Aggarwal of Orbit\u00a0Corporation<\/a> are locked in a legal battle in various courts for
\nrecovery of\u00a0 Rs 118 crore plus interst which is allegedly owed to Vardhman by Orbit.<\/p>\n

Justice Gautam Patel of the Bombay High Court, hearing a contempt\u00a0petition filed by Vardhman Developers on the issue, had recently\u00a0directed Gunjan to file a reply to the contempt petition by June 11.<\/p>\n

Mumbai Mirror<\/a> did not give opportunity to comment<\/h4>\n

In the legal notice,\u00a0 the legal attorneys of Gunjan, while demanding\u00a0an apology, said that the headline of the impugned article about\u00a0Gunjan facing a contempt was itself defamatory. Moreover, Gunjan was\u00a0not contacted for her comment on the issue. The article was allegedly\u00a0one-sided, said the notice.<\/p>\n

The Article\u2019s sub-headline \u201cDisregarding the injunction granted by the\u00a0Bombay High court<\/a> she allegedly settled a tenancy dispute with a state\u00a0politician\u201c is prima facie \u201cfalse\u201d, said the notice. \u201cOur client\u00a0(Gunjan) has in no manner disregarded an injunction of the court and\u00a0the allegation is baseless. Only a contempt petition\u00a0 has been filed\u00a0against her. Therefore imputations against\u00a0 her in the article, under\u00a0the word allegedly, pre-supposes a judicial process.\u201d<\/p>\n

The legal notice further said that though the impugned article in Mumbai Mirror<\/a> talks about Gunjan, her husband\u2019s photograph has been\u00a0published\u00a0 and the imputation is clear that she is guilty . \u201cWe wish to state once more that the\u00a0contempt petition is subjudice and no public interest will be served\u00a0by imputing that she will be held guity of contempt and therefore sentenced”, the notice added.<\/p>\n

The notice said \u201cGunjan was not an accused in any proceedings.\u00a0 She is\u00a0in full compliance with the court orders as to garnishment. There has\u00a0been a garnishee order and she was ordered not to create any third\u00a0party rights on the Marine Drive flat which is the subject matter of\u00a0the article. The issue before the small causes court was not the one\u00a0that involved our client creating third party rights but was a \u00a0settlement to pending litigation which was reopened on the instruction\u00a0of the court and after the advise of the counsel.\u201d<\/p>\n

Gunjan shall also be approaching the Press Council of India<\/a>.<\/p>\n
